TERMS OF SERVICE

These Terms of Service (“Terms”) apply to your access to and use of the ADVINCI website (the “Site”) and any purchases you make through the Site. By using the Site or placing an order, you agree to these Terms. If you don’t agree, please do not use the Site.
The Site is operated by Da Vinci Pet Intelligence (Shenzhen) Co., Ltd. (“ADVINCI,” “we,” “us,” or “our”), a company organized under the laws of the People’s Republic of China.

You must be at least the age of majority where you live to place an order on our Site.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
We work hard to present accurate product descriptions, photos, specifications, pricing, and inventory availability. However, errors and delays can happen (including inventory sync delays).
Product images are for reference only. Minor variations may occur due to production updates or different batches.
We reserve the right to correct errors and update information at any time.
Prices are shown at checkout and may change without notice.
Payments are processed through the checkout options available on the Site.
Taxes/Duties: Depending on your location, you may be responsible for applicable taxes, customs duties, or import fees.
Your order is an offer to purchase. We accept an order when we confirm fulfillment/shipment. Order confirmation emails do not guarantee acceptance.
We may cancel or refuse an order if, for example:
the item is unavailable,
there is a pricing/listing error,
the address is incomplete or undeliverable,
we suspect fraud or unauthorized activity.
If we cancel after payment, we will issue a refund to the original payment method (timing depends on your payment provider).
Shipping options, costs, and estimated delivery times appear at checkout and/or in our Shipping Policy. Delivery estimates are not guarantees.
Enclosure orders are generally available only for U.S. shipping addresses (as shown at checkout).
We may fulfill U.S. orders using third-party logistics partners, including Amazon Multi-Channel Fulfillment (MCF) using our **Amazon FBA inventory. Packaging and carriers may vary based on the fulfillment method.
Rack orders may ship internationally from China, subject to destination-country rules and carrier availability. International shipments may require additional time for customs clearance. You are responsible for any applicable duties, taxes, or import fees.
You are responsible for providing a complete and accurate shipping address. If a shipment is delayed, returned, or requires extra handling due to address issues, you may be responsible for additional costs.
Risk of loss transfers to you upon delivery to the carrier or upon delivery to your address, as required by applicable law.
Returns, refunds, and warranty coverage are governed by our posted policies, including our Shipping Policy and Return/Warranty Policy (together, the “Policies”). The Policies are incorporated into these Terms by reference.
If you purchased ADVINCI products through a third-party marketplace or retailer, their return/warranty policies may apply.
From time to time, we may offer promotions or discount codes. Promotions may have limits (e.g., expiration dates, product eligibility, one-time use) and can be changed or ended at any time unless prohibited by law.
You agree not to:
violate any laws or third-party rights,
interfere with the Site’s security or operation,
scrape, reverse engineer, or misuse the Site,
submit harmful, abusive, or misleading content.
We may suspend or terminate access if we believe you violated these Terms.
All content on the Site (including text, images, videos, logos, and product design elements) is owned by ADVINCI or licensed to us and is protected by applicable intellectual property laws. You may not use our content for commercial purposes without written permission.
The Site may use or link to third-party services (such as payment processors, shipping carriers, or apps). We are not responsible for third-party services or their policies. Your use of third-party services is subject to their terms.
THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” TO THE MAXIMUM EXTENT PERMITTED BY LAW.
We do not guarantee the Site will be uninterrupted or error-free. Any general husbandry/setup guidance we provide is informational only and not veterinary advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVINCI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR LOST DATA).
In any event, our total liability for any claim related to an order will not exceed the amount you paid for the product(s) giving rise to the claim, unless applicable law requires otherwise.
You agree to indemnify and hold harmless ADVINCI from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.
Your use of the Site is also governed by our Privacy Policy.
Governing Law: These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules.
Arbitration: Any dispute arising out of or relating to these Terms, your order, or the products shall be finally resolved by arbitration seated in Hong Kong, administered by the Hong Kong International Arbitration Centre (HKIAC) under its applicable rules. The language of arbitration shall be English.
Consumer Rights & Small Claims: Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law. Where permitted, you may bring an individual claim in a small-claims court instead of arbitration.
(Why this is practical: arbitration awards are widely recognized/enforced internationally under the New York Convention framework, which helps cross-border enforceability.)
We may update these Terms from time to time. The updated Terms will be posted on the Site with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
